A mortgage of record is cleared by recording a mortgage satisfaction, often called a satisfaction piece. A payoff statement shows the amount needed to pay the loan, but it does not release the lien from the land records. The original note evidences the debt and may be marked paid, but it is not the recorded release instrument. A certified copy of the original mortgage only proves the existence or contents of the recorded mortgage; it does not satisfy it. A quit claim deed conveys whatever interest the grantor may have, if any, but it does not include a warranty of title. That is the key distinction. A quit claim deed can be used to release possible claims, remove a cloud on title, or transfer a grantor’s existing interest without guaranteeing that the interest is valid or marketable. Because there is no covenant of warranty, the grantee receives no assurance that the grantor owns good title or that the title is free from defects. A state tax lien filed in the county where the taxpayer owns property operates as a lien against the taxpayer’s property in that county, not merely against one specifically described parcel or only when the property is sold. Tax liens are involuntary liens created to secure unpaid tax obligations and must be considered in title examination because they can affect sale, refinance, priority, and insurability. Pennsylvania tax lien rules provide that, upon entry of record by the prothonotary where the property is situated, the tax amount is a lien in favor of the Commonwealth against the taxpayer’s real property and certain personal property. A life estate lasts only for the measuring life, usually the life tenant’s life. When Karen dies, her life estate terminates automatically. The future interest holder, called the remainderman, then becomes entitled to possession or ownership according to the instrument that created the life estate. The property does not automatically pass to Karen’s spouse or heirs unless they are specifically named as the remaindermen. It also does not revert to the previous owner unless the deed or instrument created a reversion instead of a remainder. The insuring agreement states the basic promise of coverage. “Declarations” is not the standard title-policy section used for the insurer’s claim rights. Failing to promptly provide a reasonable explanation for the denial of a claim, when done with enough frequency to indicate a business practice, is an unfair claim settlement practice and therefore an unfair insurance practice. It is not merely contractual liability, because the question describes a regulatory claims-handling violation. It is unrelated to a grace period, which concerns time to pay premiums. It is also not necessarily a fraudulent insurance act because fraud requires deception or false representation. Pennsylvania’s Unfair Insurance Practices Act specifically identifies as an unfair claim settlement practice the failure to promptly provide a reasonable explanation of the policy basis, facts, or law for denying a claim or offering a compromise settlement.

Probate is used to administer a decedent’s estate and determine who has legal authority or entitlement to receive the decedent’s property. In title work, probate matters are important because title may pass through a will, intestacy, executor, administrator, heirs, or devisees. The best answer is therefore “to establish heirs.” Probate does not exist to avoid inheritance tax; tax issues may arise during administration, but avoidance is not its purpose. It also does not transfer a deceased person’s debts or foreclose liens. A closing protection letter protects a covered party against certain losses caused by the title insurer’s issuing agent or approved attorney in connection with the closing. The escrow or closing agent is the party whose misconduct or failure to follow written closing instructions may trigger the CPL protection; that agent is not the protected party under the letter. The Pennsylvania TIRBOP/ALTA CPL form identifies the protection as indemnity for the addressee’s actual loss of funds and ties eligibility to the lender or purchaser/lessee role in the transaction. A leasehold interest is an insurable interest in title insurance. Title insurance can insure different estates or interests in land, including fee simple estates, leasehold estates, life estates, and easements. A leasehold policy protects the insured leasehold interest rather than full ownership of the fee estate. It is not a lien interest, because a leasehold gives the tenant a possessory estate or contractual property interest, not a security interest for debt. It is also not “usury,” which concerns unlawful interest on loans. A mortgage lien is voluntary because the property owner intentionally grants the mortgage as security for a debt. Those are involuntary liens because they do not depend on the owner voluntarily pledging the property as collateral. This difference is critical in title work because voluntary liens are usually created by recorded security instruments, while involuntary liens may arise from statutes, judgments, taxes, or construction claims. A legal entity can be licensed or certified as a title insurance agent or agency. Pennsylvania title insurance law recognizes agencies that conduct title insurance business on behalf of a title insurer, and the statute defines an agency as an individual person, partnership, corporation, or other legal entity. The main purpose of an endorsement is to modify the policy. In title insurance, an endorsement can add, limit, delete, clarify, or expand coverage depending on the approved form and underwriting requirements. It may affect premium, but changing the premium is not the purpose of an endorsement. The policy’s insuring provisions and covered risks describe the core coverage; the endorsement alters how that policy applies to a particular transaction or risk. For example, endorsements may address access, zoning, restrictions, manufactured housing, survey matters, or additional insureds. Title passes by delivery and acceptance of the deed, not merely by signing, acknowledgment, or recording. Signing shows execution by the grantor, but a deed does not operate as a conveyance unless delivered with intent to transfer and accepted by the grantee. Acknowledgment supports recordability, but it does not by itself complete transfer of title. Recording gives public notice and protects priority against later purchasers or creditors, but recording is not the act that transfers title between grantor and grantee. This distinction is fundamental in title examination because an examiner must confirm execution, delivery, acceptance, and record notice.
